Agreement and Scope
These Terms of Service (“Terms”) govern access to and use of the Marbleland Labs website, Marbleland platform, related dashboards, software, application interfaces, demos, content and services that reference these Terms (collectively, the “Services”). “Marbleland,” “we,” “us,” and “our” refer to Marbleland Labs.
By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Services.
Separate products, integrations or third-party services—including VencOS, Solcast, KOLdex and EventCap—may have additional terms. Where product-specific terms conflict with these Terms, the product-specific terms control for that product.
Eligibility and Accounts
You must have legal capacity to enter into these Terms and must satisfy any age or jurisdictional requirements applicable to the feature you use. Unless a product expressly states otherwise, the Services are intended for adults and business users.
- You are responsible for accurate registration information, credentials and account security.
- You must promptly notify us of suspected unauthorized access.
- You may not sell, lease, transfer or share account credentials in a way that defeats access controls.
- We may require additional verification for features involving financial, blockchain, creator, enterprise or automated workflows.
Nature of the Services
Marbleland is designed as business and market decision infrastructure. The Services may organize data, generate summaries, rank opportunities, display market signals, simulate scenarios, connect third-party data sources, surface recommendations and support workflow automation.
Some features may be experimental, preview, beta, simulated or illustrative. A feature label, interface notice or product documentation may identify when an output is not live or not connected to verified production data.
AI and Automated Outputs
The Services may use statistical models, artificial intelligence, rules engines or automated processing. Outputs may be incomplete, probabilistic, stale, inconsistent or incorrect. You must independently evaluate material decisions.
- AI-generated content is not a guarantee of accuracy or outcome.
- Confidence indicators are model or system estimates and are not promises.
- Automated recommendations do not replace professional judgment, due diligence or required approvals.
- We may impose human-review, risk, freshness, authorization or evidence gates before an action can be executed.
No Investment, Legal, Tax or Fiduciary Advice
Unless expressly agreed in a separate written engagement, the Services provide software and informational tools only. Nothing in the Services constitutes investment advice, a securities recommendation, brokerage, dealing, asset management, custody, legal advice, tax advice, accounting advice or a fiduciary relationship.
You remain solely responsible for investment, business, market-entry, trading, funding, hiring, launch, creator, automation and other decisions.
Financial, Prediction-Market and Blockchain Information
Market prices, probabilities, volumes, liquidity, creator metrics, blockchain records and other external information may be sourced from third parties and may be delayed, incomplete, revised or unavailable. Display of a market, asset, token, project, creator or opportunity does not constitute endorsement.
Blockchain transactions may be irreversible. Public blockchain information may remain public indefinitely. If a feature interacts with a wallet, smart contract or external protocol, you are responsible for verifying transaction details before signing.
Third-Party Services and Integrations
The Services may link to or integrate APIs, data providers, wallets, exchanges, prediction markets, social networks, analytics providers, payment providers, cloud services or other third parties. Third-party services are governed by their own terms and policies.
We are not responsible for third-party outages, pricing, data quality, security practices, content, policy changes, API limits or actions. We may modify or discontinue an integration when necessary for reliability, compliance, security or product reasons.
Subscriptions, Fees and Payments
If paid features are offered, applicable pricing, billing cycle, usage limits, taxes, renewal terms and payment method will be presented before purchase or in an applicable order form. Fees are non-refundable except where required by law or expressly stated otherwise.
You authorize us and our payment providers to process applicable charges. You are responsible for taxes, network fees, transaction fees and third-party charges unless the checkout or product terms state otherwise.
User Content and Data
You retain rights you hold in content, prompts, project information, files, instructions and other materials you submit (“User Content”). You grant Marbleland a limited license to host, process, reproduce and transform User Content as necessary to provide, secure, maintain and improve the Services, subject to our Privacy Policy and applicable product settings.
You represent that you have the rights and permissions necessary to submit User Content and that its use through the Services does not violate law or third-party rights.
Intellectual Property
The Services, including software, interface designs, documentation, branding, trademarks, models, compilations, graphics and proprietary workflows, are owned by Marbleland or its licensors and are protected by applicable intellectual-property laws.
Except for rights expressly granted in these Terms, no rights are transferred to you. You may not remove proprietary notices, misrepresent ownership, copy protected components beyond permitted use, or use Marbleland branding in a manner that implies endorsement without authorization.
Acceptable Use and Prohibited Conduct
You must comply with the Acceptable Use Policy. Among other things, you may not use the Services to violate law, compromise systems, mislead users, manipulate markets, evade access controls, distribute malware, conduct unauthorized surveillance, infringe rights or interfere with other users.
We may investigate suspected abuse and may restrict or suspend access to protect users, infrastructure, third parties or the integrity of the Services.
Confidentiality and Enterprise Information
If the parties exchange non-public business, technical or commercial information under circumstances that reasonably indicate confidentiality, the receiving party should use reasonable care and use the information only for the intended business purpose. Separate nondisclosure agreements or enterprise contracts control where applicable.
Service Changes, Availability and Beta Features
We may add, remove, modify, suspend or discontinue features. We do not guarantee uninterrupted availability, error-free operation, specific data coverage, permanent integrations or a particular feature roadmap.
Preview and beta features may change materially, may be subject to additional limits and may not be suitable for production-critical use.
Security and Responsible Use
You are responsible for maintaining appropriate endpoint, credential, wallet and organizational security. Do not disclose secrets, private keys, seed phrases or credentials through the Services unless a feature expressly requires and securely supports that data type.
Security vulnerabilities should be reported to security@marbleland.io and handled in accordance with our Responsible Disclosure Policy.
Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary for nonpayment, security, abuse, legal requirements, material breach, risk management or discontinuation of a service.
Provisions that by their nature should survive termination—including intellectual-property, disclaimers, limitations, indemnity and dispute provisions—survive.
Disclaimers
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” Marbleland disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability and accuracy, except where such disclaimers are prohibited by law.
See the General Disclaimer and Risk Disclosure for additional information.
Limitation of Liability
To the maximum extent permitted by applicable law, Marbleland and its affiliates, personnel, licensors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, revenue, business opportunity, data, goodwill or anticipated savings; trading or investment losses; or losses arising from third-party services, market movements, automated decisions or user-signed transactions.
Where liability cannot be excluded, aggregate liability will be limited to the greater of the amount you paid to Marbleland for the affected Service during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law. This limitation does not apply where prohibited by law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Marbleland and its affiliates, personnel and service providers from third-party claims arising from your unlawful use of the Services, your User Content, your violation of these Terms or your infringement of third-party rights.
Governing Law and Disputes
These Terms are subject to applicable law and any mandatory consumer or commercial protections that cannot lawfully be waived. Marbleland may identify a specific governing law, venue or dispute procedure in an order form, product-specific terms or a future update after its operating entity and jurisdiction are finalized.
Before filing a formal claim, you are encouraged to contact legal@marbleland.io so the parties can attempt to resolve the issue informally.
Changes to These Terms
We may update these Terms to reflect product, legal, security or operational changes. The “Last updated” date indicates the latest revision. Where required by law, we will provide additional notice before material changes take effect.
Notices and Contact
Legal notices to Marbleland should be sent to legal@marbleland.io. General product support should be sent to support@marbleland.io.
If Marbleland publishes a registered entity name, mailing address or jurisdiction-specific contact in the future, that information will supplement the electronic contact details stated here.
